Delhi HC refuses to interfere with order evicting disowned son

New Delhi, Sep 29 (PTI) The Delhi High Court has refused to interfere with an order evicting a "disowned" son from the house of his father who filed a complaint against him under the senior citizen law.

Justice Yashwant Varma, while dismissing a challenge by the son to the eviction order under the Maintenance and Welfare of Parents and Senior Citizens Act, noted that the property was not ancestral in nature and it was the senior citizen who was entitled to claim exclusive rights over it and in view of the “proven allegations of harassment,” no interference was called for.

The petitioner challenged the order passed by the Divisional Commissioner affirming the directions for eviction by the District Magistrate on the complaint lodged by the senior citizen father.
